These Terms and Conditions ("Terms") govern your access to and use of all services, programs, websites, mobile applications, software, and platforms operated by Stay Viral Group LLC ("Stay Viral," "we," "our," or "us").

By accessing or using Stay Viral services, you agree to be bound by these Terms. If you do not agree, you may not use our services.

1. Services Overview

Stay Viral provides:

  • Educational programs and coaching
  • Creator and affiliate training related to TikTok Shop
  • Agency services connecting creators, brands, and affiliates
  • Software tools, analytics, and mobile applications
  • Community access (including Discord or similar platforms)

We do not guarantee earnings, revenue, virality, brand deals, or platform outcomes.

2. Eligibility

You must be 18 years or older to use Stay Viral services. You represent that all information you provide is accurate and truthful.

3. No Affiliation with TikTok

Stay Viral is an independent company and is not owned, operated, sponsored, or endorsed by TikTok or ByteDance. All TikTok trademarks belong to their respective owners.

4. TikTok Integration & Platform Use

When using features connected to TikTok or TikTok Shop:

  • You authorize Stay Viral to access only permitted TikTok data
  • Access complies with TikTok's Developer and Platform Policies
  • You may revoke access at any time through TikTok or your account
  • Stay Viral is not responsible for changes, suspensions, or policy enforcement by TikTok
  • Your use of TikTok services is governed by TikTok's own terms

5. Payments, Fees & Billing

  • Fees may include one-time purchases, subscriptions, retainers, or performance-based services
  • All fees are disclosed prior to purchase
  • You authorize Stay Viral to charge your selected payment method
  • All sales are final unless expressly stated otherwise in writing

Chargebacks, disputes, or abuse of payment systems may result in immediate termination of services.

6. No Refund Policy

Due to the nature of digital products, coaching, proprietary systems, and agency onboarding costs, all purchases are non-refundable, unless otherwise required by law or explicitly stated in a written agreement.

7. Intellectual Property

All Stay Viral content, including but not limited to trainings, videos, documents, software, branding, systems, and frameworks, is the intellectual property of Stay Viral Group LLC and may not be copied, resold, redistributed, or exploited without written permission.

8. User Conduct

You agree not to:

  • Violate any laws or third-party platform policies
  • Misrepresent earnings, results, or affiliation
  • Share confidential or proprietary Stay Viral materials
  • Disrupt community spaces or other users
  • Abuse coaches, staff, or members

Violations may result in termination without refund.

9. Community Platforms

Access to community platforms (e.g., Discord) is a privilege. Stay Viral reserves the right to remove users who violate rules, engage in harassment or spamming, act in bad faith, or undermine platform integrity.

10. Disclaimer of Earnings & Results

Stay Viral does not guarantee:

  • Income or profit
  • Virality
  • TikTok account approval or TikTok Shop acceptance
  • Brand deals or affiliate commissions

Results vary based on effort, skill, market conditions, and platform changes.

11. Limitation of Liability

To the maximum extent permitted by law, Stay Viral shall not be liable for:

  • Lost revenue or profits
  • Platform suspensions or bans
  • Business interruptions
  • Indirect or consequential damages

Your total liability shall not exceed the amount paid to Stay Viral.

12. Indemnification

You agree to indemnify and hold harmless Stay Viral Group LLC, its officers, directors, employees, and contractors from claims arising from your misuse of services or violation of these Terms.

13. Termination

Stay Viral may suspend or terminate access at any time for violation of these Terms, fraud, non-payment, or abuse, without refund.

14. Modifications to Services & Terms

We may update or modify services, pricing, or these Terms at any time. Continued use constitutes acceptance of updates.

15. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles.

16. Dispute Resolution

Any dispute shall be resolved through binding arbitration in Florida, unless otherwise required by law.

17. Severability

If any provision is found unenforceable, the remaining provisions remain in effect.
